Uber replaced fixed fares with Dynamic (Upfront) Pricing as a way to cut driver pay. Many drivers report lower pay, less predictable work and a lack of transparency about how pay and trip allocation are determined. DRA in collaboration with hestia.ai and personaldata.io and the french organisation Force Ouvrière INV preparing a collective legal challenge to hold Uber accountable.
Register your interest now — there is no commitment. If and when we proceed, we will contact you with next steps.
Why register your interest
- No obligation to join litigation now — only to be contacted about options
- Helps build the collective case needed to obtain compensation and a change in practice
- You will receive updates and clear guidance on next steps if we proceed
Watch the video below of data pioneer and researcher, Paul-Olivier Dehaye, speak about the power Uber holds over drivers' data.
You are eligible to register if
- You provided services as an Uber driver via the Uber driver app at any time after November 2020; and
- You understand this is intended as a collective claim under applicable law (for example Article 37 of the Dutch GDPR Implementation Act and/or Article 3:305a DCC, or corresponding national legislation).
Summary of the claim DRA (and groups we are working with) are preparing a collective action to hold Uber accountable for breaches of the EU General Data Protection Regulation (GDPR) related to its Algorithmic Pay system. The main breaches are that:
- Automated decision-making: Since introducing Dynamic and Algorithmic Pay, Uber has used algorithms and automated decision-making to determine driver pay and allocate work in ways that violate GDPR Article 22 (no clear, meaningful explanation to affected drivers; no valid legal basis or required safeguards).
- Unlawful use of data: Uber used drivers’ personal data to train algorithms without proper consent or lawful basis.
- Unlawful international transfers: Uber transferred drivers’ personal data from the EU to the US without required safeguards (breach of Chapter V of the GDPR)
- We are also conducting research for additional claims
What we will seek
- Material damages: compensation for lost earnings — i.e., the difference between what you were paid and what you would have received without Dynamic Pay.
- Non-material damages: compensation for distress, loss of control over personal data, and unpredictability caused by the automated system.
Why this matters Since the introduction of upfront fares and variable commission
- Driver pay has fallen and continues to fall;
- Uber’s commission levels and fares have increased;
- Drivers face less predictability and reduced control over earnings.
We believe these effects are caused by algorithmic systems deployed without proper legal safeguards or transparency.
